Government announced in the 2023-24 Budget amendments to the non-arm’s length income (NALI) provisions which apply to non-arm’s length expenditure (NALE) and legislation has been drafted to enact these amendments and has been under consultation with industry.

In this on demand training we will update you on the changes to the NALI and NALE provisions in the Tax Act impacting SMSFs to understand the circumstances that can give rise to income of an SMSF being treated as NALI; when an SMSF will have NALE; and the tax implications. We will also utilise case studies to explore the interaction of the NALI rules with the SIS trustee remuneration rules, contribution rules and CGT provisions, and to identify what SMSF trustees can do to avoid being caught by the NALI provisions.
